Program: “IP Damages and Injunctions”

Speakers: Robert Vigil, Vice President, and Kara Gorski, Manager, Analysis Group, Inc., Washington, D.C., will focus their presentation on lost profits damages, reasonable royalty damages, and the law and economics of permanent injunctions in light of the eBay v. MercExchange decision and other relevant cases.

Dr. Vigil specializes in the application of economics and finance to intellectual property, antitrust, and general commercial litigation damages-related matters. His work includes assessment of damages in complex litigation cases, including analyses of lost profits, reasonable royalties, price erosion, and unjust enrichment. Dr. Vigil’s experience spans a wide variety of industries including telecommunications, computer hardware and software, pharmaceuticals, medical devices, and consumer products. In addition, Dr. Vigil has experience in technology valuation and licensing strategy in prospective non-litigation licensing matters. He has worked with inventors, corporations, and licensing experts to provide analysis of the products and markets to which technologies may be applied. He also has provided intellectual property owners with analysis of and recommendations for the appropriate terms of technology transfer and performed prospective market valuations of assorted intellectual property in an array of industries. He has given presentations on intellectual property issues before professional and academic groups.

Dr. Gorski is an expert in the application of microeconomic theory to intellectual property valuation and regulation. She has conducted economic analyses of damages related to patent and copyright infringement, breach of contract, and the misappropriation of trade secrets. Dr. Gorski’s experience spans various industries, including semiconductors, medical devices, and telecommunications.
