Program: SVIPLA, Santa Clara Law’s High Tech Law Institute and Berkeley\'s Center for Law & Technology are pleased to present our distinguished panel to discuss the question of “Do Recent Changes to U.S. Patent Law and Practice Weaken or Strengthen the Patent System?” The following actual and proposed changes in the context of both US innovation and international competitive position will be discussed.

1. Patent Procurement/ Patent Quality issues: Nonobviousness (KSR), Continuation Limits, 5/25 Rule and ESD, First to File, Mandatory Publication, Post Grant Opposition.

2. Enforcement Issues/ Licensing and Litigation: Declaratory Judgments (Medimmune, Sandisk), Injunctions (eBay and aftermath), Damages Apportionment, Willfullness (Seagate), Venue, Interlocutory Appeals.
