REGISTER TODAY FOR SEPTEMBER 13 PROGRAM: “Non-Obviousness in Light of KSR, Pfizer and Takeda: Possible Patent Strategies”

Date: Thursday, September 13, 2007

Location: Crowne Plaza Cabana Hotel, Palo Alto (El Camino Real north of San Antonio Road)

Time: 6:00 p.m., cocktails and registration; 7:00 p.m., dinner and program

Program: Recent rulings from the Supreme Court in KSR v. Teleflex, Pfizer v. Apotex and Takeda v. Teva require modification of approaches to patenting combinations of previously known elements. The main points of the above cases are that a claim is likely to be obvious: (1) if person\'s of ordinary skill uses ordinary creativity to arrive at the claimed invention, (2) if the elements in the claim work in their expected ways, (3) if there are a limited number of options from which to choose, and (4) if there is no unexpected result produced. These points are illustrated in several recent decisions. Developing ways of prosecuting patent applications in light of the new rulings requires understanding of the so called \"Graham factors\" and their application to facts of a particular invention. The trend appears clear. The standards of non-obviousness will be more difficult to reach as a result of these decisions. However, careful scrutiny of inventors\' information may yield new tools for overcoming potential obviousness rejections.
